Family Based Immigrant Visas
Of the 1 million green cards issued by the U.S. each year, 700,000 are devoted to family-based immigration. The timeline to obtain a green card for your family member depends on your status priority:
- Immediate family members such as spouses, minor children and parents of U.S. citizens have first priority. The process to obtain a green card for these family members usually only takes about six months.
- Adult children of U.S. citizens have second priority.
- Applications for spouses and unmarried children of lawful permanent residents can take significantly more time to process and approve. It can take four years to obtain these green cards. However, if we can obtain citizenship for you, your family would move to first priority status for their green card applications.
- Brothers and sisters of U.S. citizens may have to wait 15 years before being issued a green card.
It is important to begin the process as quickly as possible. The longer you wait to begin the application process, the longer it will take to have a green card issued to your family member.
K1 and K2 visas may be granted to fiancés of U.S. citizens and the fiancés children. There are strict rules that apply to K1 and K2 visas, so it is important to discuss your situation with an experienced immigration lawyer.
K3 and K4 visas may be granted to spouses of U.S. citizens and the spouses' children. We will help your spouse who is currently waiting for an immigrant visa to apply for a K3 or K4 visa.
Request for I-751 Removal of Condition must be made in a timely fashion. At any time after the 21st month and prior to the expiration of conditional residency, we will help you file a request for the removal of condition on your green card and grant of a ten year green card.
International Adoptions: We have extensive experience guiding clients through international adoptions. When a U.S. citizen adopts a child under the age of 16, the child automatically becomes a U.S. citizen.
We will guide you through the process and work hard to achieve your goals. Contact us to discuss your family based immigrant visa and green card questions.
